Transparency Reporting and Government Takedown Requests

GitHub has updated its transparency reporting methodology, leading to a significant increase in reported government takedown requests. In the first half of 2026, the platform received 708 such requests, compared to 98 in all of 2025. This increase is attributed to changes in how GitHub tracks and reports these requests, including the inclusion of all types of government takedown requests, regardless of their basis, and the counting of duplicate requests. Despite the higher volume of reported requests, the actual number of content removals remains low, with most takedowns processed under local law or Terms of Service violations being rare.

State Legislative Engagement and Policy Developments

GitHub has been actively involved in state-level policy discussions, particularly in California, Colorado, and Illinois. These efforts have focused on issues such as content provenance and AI transparency, as well as age assurance and youth online safety. In California, the California AI Transparency Act (SB 1000) was improved through collaboration with the open source community, though implementation challenges remain. In Colorado, changes to the Age Attestation on Computing Devices law (SB 26) addressed concerns about the impact on open source software. In Illinois, the Children’s Social Media Safety Act (HB 5511) was signed into law, but further amendments are needed to address implementation challenges.

Looking Ahead: Policy Priorities and Engagement

GitHub continues to monitor and engage with emerging policy issues that affect developers and the open source ecosystem. Key areas of focus include the DMCA Section 1201 triennial rulemaking, which considers temporary exemptions for developers and researchers, and debates around young people’s access to AI tools. GitHub emphasizes the importance of involving developers and open source stakeholders in policy discussions to ensure that regulations are informed by technical expertise and do not inadvertently harm the open source community.

As policy decisions increasingly shape the development and collaboration processes in open source, GitHub remains committed to providing transparency, supporting informed policy development, and fostering collaboration between developers, policymakers, and open source stakeholders.
